Orders & pricing

Prices are in US dollars and shown before you pay, including quantity discounts, shipping and any sales tax. An order is accepted when we send your order confirmation; we charge your card when you place the order.

If a price or product is listed incorrectly because of an error, we’ll contact you before production and you can choose to continue at the correct price or cancel for a full refund.

Custom products & proofs

Every item is made to order from the design you submit. The on-screen preview is an accurate representation of placement and scale, but colors can vary slightly between screens and materials, and natural materials like leatherette vary in grain and tone.

We review artwork before production and may contact you about quality issues. You’re responsible for the spelling, content and final appearance of the design you approve.

Your artwork & rights

You keep all rights to your artwork. When you upload it, you confirm that you own it or have permission to use it, and that producing it won’t infringe anyone’s copyright, trademark, publicity or other rights.

You grant us a limited license to store, reproduce and modify your artwork only as needed to produce, ship and support your orders (for example, resizing or creating a white underbase). We won’t use your artwork for anything else — including marketing — without your permission.

You agree to cover any claims, costs or damages that arise because artwork you submitted infringes someone else’s rights.

Content policy

We make a lot of bold stuff, but we won’t produce designs that:

• Infringe a trademark, copyright or other intellectual property you don’t have rights to use (including sports teams, brands and characters)
• Promote hate, violence or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability or national origin
• Harass, threaten or defame a real person
• Contain sexually explicit content involving minors, or any content that’s illegal
• Imitate official insignia, badges or government identification

We may refuse or cancel any order at our discretion — including ones we believe violate this policy. If we cancel an order, we’ll refund you in full.

Production, shipping & delivery

Production and delivery times are estimates, not guarantees, though we work hard to hit them. Title and risk of loss pass to you when the carrier delivers your package. See our shipping policy for details.

Returns, reprints & cancellations

Custom items can’t be returned for change of mind. Defective, damaged or incorrect items are covered by our reprint guarantee for 30 days after delivery. See Returns & reprints.

Accounts

You’re responsible for keeping your password secure and for activity on your account. You must be at least 18, or have a parent or guardian’s permission, to place an order. We may suspend accounts that misuse the site.

Our site & content

The Badass Swag and Badass Patches names, logos, product illustrations, site design and copy belong to us. You may not copy or reuse them without permission, or use the site in a way that disrupts it or tries to access data that isn’t yours.

Warranty & liability

Apart from our reprint guarantee and any rights you have by law, products and the site are provided “as is”. To the fullest extent permitted by law, our total liability for any claim related to an order is limited to the amount you paid for that order, and we aren’t liable for indirect or consequential losses.

Nothing in these terms limits rights you have under consumer protection laws that can’t be waived.

Governing law & changes

These terms are governed by the laws of the State of North Carolina, USA. We may update them from time to time; the version in effect when you place an order applies to that order. Questions? Email support@badassswag.com.
